上诉庭今日宣判,居民协会可以规定没有付管理费的业主和居民,必须自行操作拦车杆。
《马新社》报道,上诉庭三司是推翻高庭裁决,批准八打灵再也市Parkville居民协会主席周浩满(Chow Hau Mun,译音)的上诉。
周浩满之前向八打灵再也市议会争取,规定居住在Parkville但没付管理费的业主和居民,或非居民协会成员,必须自行操作拦车杆,不得要求保安员帮忙。

PUTRAJAYA: A registered residents’ association within the Petaling Jaya City Council (MBPJ) can impose conditions on members who do not contribute towards security and maintenance, the Court of Appeal has ruled.
A three-member bench chaired by Justice Has Zanah Mehat said a condition set by the Parkville residents’ association requiring non-paying members to operate the boom gates themselves is reasonable.
Has Zanah said the decision was in line with a 2015 Federal Court ruling in the case of Au Kean Hoe v Persatuan Penduduk D’Villa Equestrian.
In that case, the apex court ruled that the construction of a guardhouse and boom gates did not amount to an “obstruction” under Section 46(1)(a) of the Street, Drainage and Building Act 1974.
Section 46(1)(a) makes it an offence for any person to erect an obstruction in any public place.
“There has to be a balance between the interests of the community as a whole and the individuals (non-paying residents),” said Has Zanah when allowing the appeal by Parkville residents’ association president Chow Hau Mun.
Has Zanah, who sat with Justices Che Ruzima Ghazali and See Mee Chun, said it would be unreasonable for non-paying residents to enjoy the benefits of a security system without having to contribute towards it.
The oral decision was delivered online after the bench heard submissions by parties.
Lawyers Malik Imtiaz Sarwar and A Surendra Ananth represented Chow, while Yatiswara Ramachandran appeared for MBPJ.
Chow was appealing the decision of the Shah Alam High Court last year dismissing his judicial review application.
Justice Shahnaz Sulaiman had held that the residents’ association could not impose such conditions on those who refuse to pay the monthly service fees.
She said MBPJ’s gated community guidelines do not allow associations to discriminate against non-paying residents and non-members.
Chow had filed for the judicial review after MBPJ in 2021 rejected the association’s application for permission to make non-paying members and non-members operate the boom gates themselves.
Dismissing the application, the judge ruled that MBPJ could prohibit any association under its authority from imposing unreasonable conditions on homeowners.
She said MBPJ’s decision not to allow the association to impose the rule was not illegal, irrational or unreasonable.

The warning followed allegations that many residents in gated communities were found outside their homes, with some said to be jogging in large group.

We are indeed grateful that our residents’ association was receiving another grant from the ROS amounting to RM10,000.00 for upgrading our G&G scheme security control equipment.
The application was made several months ago with the ROS following the notice given under the 2017 budget announcement.
Prime Minister Datuk Seri Najib Tun Razak had announced in Budget 2017 an allocation of RM40mil as grants to registered residents’ associations.

The annual appreciation dinner for JPP (Jawatankuasa Perunding Penduduk or Residents Consultative committee) MPSepang was held on 2/12/2016 at SAMA SAMA Hotel KLIA.
The occassion was officiated by Selangor Exco YB Tuan Ean Yong Hian Wah and our taman was represented by the RA Chairman Mr Kong Kok Meng and the RA Secretary Mr Ng Kuo Sin.

PETALING JAYA: A local actor and comedian was fined RM800 for damaging a plastic chair in a guardhouse after he was denied entry to his gated housing area for not having a security sticker.
Magistrate Salamiah Salleh said S. Gana Pragasam must serve 14 days in jail if he failed to settle the fine, which he paid.
Gana, 47, had pleaded guilty to the charge of committing mischief at the guardhouse in Taman Perumahan Atillia dan Allisia, Ara Damansara, at about 10.20pm on Aug 4.
According to facts of the case, Gana, who did not have an access card to enter the gated property where he resides, lost his cool when he was requested to use the visitor’s lane instead by a security guard…….

The dream of getting a community hall for Taman Putra Prima residents is soon to be materialized following the tender has been called by MPSepang.
The township of Taman Putra Prima which began its development some 15 years ago has over 3000 unit of residential houses and shops is still lacking of the most basic amenities such school, post office, petrol kiosk, bank, community hall etc.
Residents are getting impatient finally found the opportunity to voice out their concerns or grievances face to face to many heads of various department (Pengarah jabatan) from MPSepang. Thanks at a town-hall meeting organized by Sepang municipal councillor Mr Pulanthran who is also the Chairman of the JPP (Jawatan-Kuasa Perunding Penduduk) for the region of Taman Mas & Taman Putra Prima in response to the request by the Gabungan AGM Memorandum presented to him earlier (see exihbit below)
